The Education Amendment Act 1989 and subsequent amendments outline the functions and duties of Councils.
The functions of Council are
- to appoint a chief executive in accordance with the State Sector Act 1988, and to monitor and evaluate his or her performance;
- to prepare, negotiate and adopt a charter for the university;
- to adopt a profile for the university;
- to ensure that the university is managed in accordance with its charter and its profile;
- to determine the policies of the university in relation to the implementation of its charter, the carrying out of its profile, and, subject to the State Sector Act 1988, the management of its affairs.
The duties of Council are
- to strive to ensure that the university attains the highest standards of excellence in education, training and research;
- to acknowledge the principles of the Treaty of Waitangi;
- to encourage the greatest possible participation by the communities served by the university so as to maximise the educational potential of all members of those communities with particular emphasis on those groups in those communities that are under-represented among the students of the University;
- to ensure that the university does not discriminate unfairly against any person;
- to ensure that the university operates in a financially responsible manner that ensures the efficient use of resources and maintains the university's long-term viability.
- to ensure that proper standards of integrity, conduct, and concern for the public interest and the well being of students attending the university are maintained.
The Council's Constitution is:
- 4 members appointed by the Minister of Education;
- The Vice-Chancellor of the University of Otago;
- 3 permanent members of the academic staff of the University Council elected by the permanent members of that staff;
- 1 permanent member of the general staff of the University Council elected by the permanent members of that staff;
- 2 members elected by the students of the University;
- 1 member appointed by the University of Otago Council after consultation with the central organisation of employers as recognised under the Employment Relations Act 2000;
- 1 member appointed by the University of Otago Council after consultation with the central organisation of workers as recognised under the Employment Relations Act 2000;
- 1 member, being a member of the Dunedin City Council appointed by that Council;
- 3 graduates elected by the Court of Convocation of the University of Otago;
- Up to 3 members co-opted by the University of Otago Council.
- (No member can serve for more than 4 consecutive terms of 4 years).
