	 <title>Is Adversarialism Dead? New Foundations for Legal Process and Lawyers' Ethics</title>

	 	<p><p>The Legal Issues Centre at the University of Otago Faculty of Law is proud to be hosting the Australian and New Zealand Legal Ethics Colloquium, 9 - 10 February 2012.</p> <p>Key note speakers:</p>  <ul>     <li>Peter Cashman (Kim Santow Chair in Law and Justice, Sydney Law School)</li>     <li>W Bradley Wendel (Professor of Law, Cornell University School of Law and Visiting Scholar, University of Otago Legal Issues Centre).</li> </ul> <p>The colloquium will explore the need for new ethical frameworks, beyond adversarialism, to support new and emergent forms of legal work, particularly those currently being opened up by increasing deregulation of the legal services market. Adversarial ethics no longer sit comfortably with modern legal practice, especially that taking place outside, or challenging, the mainstream. Clients do not always want, or need, a gladiatorial contest and, over time, adversarialism may inflict unnecessary harm on lawyers, those whom they are supposed to serve as well as innocent third parties. But what new ethical theories or perspectives should lawyers turn to in order to meet challenges confronting the civil justice system? And what kind of ethics is required for alternative dispute resolution? This colloquium will examine the extent to which post- or non-adversarial ethics might inform and enrich standards of legal work before, during and after civil trials. We also need to examine whether ethical obligations should attach to those who are not gladiators, should the parties themselves, and those funding litigation, owe ethical duties, if not a legal duty to the court?</p><p>We invite consideration of the following trends:</p> <ul><li>Possible consequences for legal policy and ethics in New Zealand of the recent emergence of commercial litigation funders in Australia and Europe;</li><li>Implications for civil procedure and legal ethics of shifting from a party and lawyer-controlled, adversarial system of litigation to one in which judges, clients, funders and others exert far greater influence;</li><li>How e-discovery will re-shape professional relationships which may be transformed through increased use of expedited and impersonal processes;</li><li>The rise of client preference for non-combative styles of lawyering, eg &quot;collaborative&quot; divorce proceedings; and</li><li>The impact on professional ethics of the transfer of ownership of law firms from partners to public shareholders.</li></ul> <p>Other contributions on lawyers' ethics, the moral philosophy of legal practice, lawyers, empirical studies on lawyers and legal practice, the regulation of the legal profession, or ethics education are also welcome though we shall be concentrating on exploring the ethical dimension to civil justice reform. This is compatible with the approach taken in the International Legal Ethics Conference (ILEC) series and at previous Australian and New Zealand Legal Ethics Colloquia held at the University of Canterbury in Christchurch in 2005, and at the University of Southern Queensland in Toowoomba in 2010.</p></p>

	 <title>Numerical competence in pigeons, social evaluation in preverbal infants, and planning for the future in children</title>

	 	<p><p>At the University of Otago, Damian received his BSc in zoology in 2007 and completed his PhD in the Department of Psychology in 2011. His areas of research include comparative cognition, developmental psychology, and behavioural neuroscience. Damian is currently a Research Fellow in the Department of Psychology.</p><h2>Abstract</h2><p>My talk will focus on three lines of research. First, I will describe my research looking at numerical competence in pigeons. Specifically, I will demonstrate that pigeons are able to code the ordinal position (eg, 1st, 2nd, 3rd, 4th) of arbitrary list items. Also, I will show that pigeons can acquire a numerical rule that allows them to order novel numerosities according to their cardinal value (ie, how many elements they contain). Second, I will describe research challenging the hypothesis that children come into this world with an innate moral compass and propose an alternative account that requires no appeal to moral nativism. 	 <title>Ethnic Identity and Regionalism in the Southwest Pacific: The Melanesia/Polynesia Divide in Contemporary Regional Politics</title>

	 	<p><p>A seminar presented by Professor Stephanie Lawson, Politics and International Relations, Macquarie University</p><p>The usual terrain of the politics of ethnic identity is located at the national or subnational level, and scholarly studies of the phenomenon are usually focused on these spheres. The rise of regionalism or regionalization, however, brings with it the potential for ethnic politics to be played out on this broader stage as well. We have already seen the concept of &lsquo;culture&rsquo; extended to cover some very broad areas &ndash; &lsquo;the &lsquo;Confucian culture area&rsquo; of East Asia being one obvious example. In neighbouring Southeast Asia the &lsquo;ASEAN Way&rsquo; has also been used to characterize the diplomatic culture said to prevail in that region. The Southwest Pacific has long had its own version in the form of the &lsquo;Pacific Way&rsquo; &ndash; a diplomatic style which, like the ASEAN Way, has frequently been used to differentiate the political culture of island nations, both collectively and individually, from that of Western nations, especially Australia and New Zealand. More recently, however, the apparent unity of &lsquo;Pacific Way&rsquo; regionalism has come under strain and a growing division between the Melanesian and Polynesian sub-regions appears to be developing. This paper explores the historic construction of these categories as markers of racial, cultural and ethnic identity and their implications for contemporary regional politics.</p><p>Stephanie Lawson is currently Professor of Politics and International Relations at Macquarie University, Sydney. She has previously held chairs in Politics and International Relations, and Asia-Pacific Studies, at the University of East Anglia, and the University of Birmingham respectively and has also taught and researched at the University of New England and the Australian National University. Her research interests span the fields of political theory, comparative politics and international relations while the main themes of her research focus on culture, ethnicity, nationalism, and democracy. She has particular expertise in the politics of Pacific Island states but has also written on Singapore, Malaysia and Japan.</p></p>
