The information below has been created to assist students with understanding the investigation process. The steps below may be subject to change and the Sexual Misconduct Policy and Student Code of Conduct will always supersede this information.
- A complaint is made to the Proctor
- No-fault protective measures may be imposed on both parties equally, these are not intended as a punishment. They are imposed to keep both parties apart and safe
- The Proctor advises the affected party (the person affected by sexual harm) of their right to support and explains the process to them
- The Proctor interviews the affected party and receives their side of the story (the interview may be recorded)
- The Proctor interviews any witnesses for the affected party and obtains any other evidence that will help them reach a decision
- The Proctor advises the respondent (the person alleged to have committed the sexual harm) of their right to support, and explains the process to them
- The Proctor interviews the respondent
- The Proctor interviews any witnesses for the respondent and obtains any other evidence required for them to reach a decision
- The Proctor drafts a 'preliminary report' giving a preliminary outcome
- The Proctor's preliminary report is reviewed by SMART* and further investigation is undertaken if required
- The Proctor reaches their final conclusion and notifies both parties of the outcome and imposes sanctions (if any). Or the Proctor can elevate the matter to the Provost if the seriousness of the alleged offending means that higher-level sanctions may be required
- The respondent has the right to appeal the Proctor's decision and penalty (or both) to the Provost
- Regardless of the outcome the Proctor can impose no-fault protective measures on both parties for the duration of the time they are both students
The above process may be changed at the Proctor's discretion.
* Sexual Misconduct Action Response Team (SMART) has the primary role of overseeing processes under the Sexual Misconduct Policy to ensure proper processes are followed and that parties involved are appropriately supported.
